Terms & Conditions

Go Romana Charters / BMB Global Trading, LLC — La Romana, Dominican Republic

By submitting payment, signing electronically, or boarding the vessel, you accept all terms of this agreement.

“Go Romana Charters” refers to Go Romana Yacht Charters, operated by BMB Global Trading, LLC, including its agents, representatives, subcontractors, vessel owners, captains, crew, and any third parties providing services on behalf of Go Romana Charters.

“Guest” or “Client” refers to the primary guest who signs the charter agreement and all passengers included in the passenger list.

For purposes of this agreement, “boat,” “yacht,” “vessel,” or “charter” refers to any vessel provided by Go Romana Charters, including motor yachts, catamarans, speedboats, fishing boats, sailing vessels, and tenders.

1. Cancellation Policy

168+ hours (7+ days) before scheduled departure time

  • Full refund, minus applicable processing fees.
  • Refund issued within 14 business days.

72–168 hours (3–7 days) before scheduled departure time

  • 50% refund, or reschedule free of charge subject to availability.

Less than 72 hours before scheduled departure time

  • No refund.
  • Rescheduling subject to availability; a date change fee may apply.

No-show

Failure to arrive at the scheduled departure time without prior written notice will be treated as a no-show. No refund will be issued and the guest will be charged 100% of the charter amount.

Holiday periods (Dec 24 – Jan 7, Semana Santa)

  • No refunds regardless of cancellation timing.
  • Rescheduling within the holiday period may be available subject to availability.

2. Weather & Navy Policy

Dominican Navy (Armada) cancellation

If the Dominican Navy prohibits departure due to sea conditions or safety concerns:

  • Full refund, or reschedule at no charge subject to availability.
  • This applies year-round, including holiday periods.

Rain

Rain alone is not grounds for cancellation or refund. Charters proceed as scheduled unless the Dominican Navy prohibits departure.

Unfavorable weather without Navy decision

If weather conditions are unfavorable but the Navy has not issued a prohibition, Go Romana Charters may evaluate conditions independently. Rescheduling or cancellation decisions in this scenario are at our sole discretion.

3. Payment Authorization

By booking, the guest authorizes Go Romana Charters and BMB Global Trading, LLC to charge the card on file for:

  • Outstanding balances
  • No-show fees
  • Damage to the vessel
  • Missing or damaged equipment
  • Excessive cleaning fees
  • Any reasonable operational expenses related to the charter

4. Behavior, Safety & Prohibited Substances

Captain’s authority

The captain has full and final authority to modify itineraries, cancel water activities, return to port early, or suspend the charter for safety issues, misconduct, or illegal activity. No refunds will be issued in such cases.

Alcohol

Alcohol consumption is at the guest’s own risk. Crew may refuse service or stop activities for safety reasons.

Drugs and illegal substances

Possession, use, or transportation of illegal drugs is strictly forbidden. Violations will result in immediate termination of the charter without refund, and the guest assumes all legal responsibility.

5. Open Bar Policy

Open bar service

  • The open bar purchase is non-refundable once confirmed.
  • Unopened bottles remaining at the end of the charter are the property of the guest.
  • Opened bottles may be given to the guest at the end of the charter.
  • Quantities provided are based on standard per-person consumption estimates. Go Romana Charters does not guarantee quantities will satisfy all individual preferences.

Right to suspend alcohol service

The crew and/or captain reserve the absolute right to suspend or limit alcohol service to any passenger or the entire group if, in their sole judgment, continued consumption poses a safety risk. No refunds will be issued.

Age verification

All passengers consuming alcohol must be of legal drinking age. The primary guest is responsible for ensuring compliance for all members of their group.

6. Release of Liability & Assumption of Risk

The guest acknowledges that marine and boating activities involve inherent risks, including but not limited to:

  • Slips, falls, collisions
  • Impacts from waves or vessel movement
  • Falling overboard, drowning, or immersion injuries
  • Accidents with other vessels or mechanical failure
  • Strong wind, current, tide, or hazardous weather
  • Marine life interaction
  • Cuts, sprains, fractures, dislocations
  • Sunburn, heatstroke, dehydration
  • Damage to personal property
  • Serious injury or death

The guest voluntarily assumes all risks associated with the charter. The guest hereby releases and discharges Go Romana Charters, BMB Global Trading, LLC, vessel owners, captains, crew, employees, agents, subcontractors, and affiliates from all liability for personal injury, death, accidents, damages, or losses, even if caused by the negligence or fault of the released parties.

This release does not apply in cases of gross negligence or intentional misconduct as determined by a Dominican court.

7. Indemnification

The guest agrees to indemnify and hold harmless the released parties from any claim or demand brought by other passengers, third parties, minors under the guest’s supervision, or government authorities arising from the use of the vessel or violation of this agreement.

8. Water Activities

Swimming, snorkeling, paddleboarding, tubing, and similar activities are at the guest’s own risk. The crew is not responsible for supervising guests in the water.

9. Minors

The primary guest represents and accepts this agreement on behalf of all minors in the group and accepts all risks and releases contained herein.

10. Vessel Condition

Photos are representative of the vessel type. Actual vessels may show normal operational wear and tear but are maintained in safe, seaworthy charter condition.

11. Dispute Resolution

All disputes arising from this agreement shall be resolved through arbitration under Dominican law, exclusively in the courts of La Romana, Dominican Republic.

12. Personal Property

Go Romana Charters is not responsible for the loss, theft, or damage of personal items, including but not limited to phones, cameras, jewelry, clothing, and luggage. Guests are solely responsible for their belongings throughout the charter.

13. Passenger Capacity

Only passengers listed in the charter agreement’s passenger list may board the vessel. Exceeding the vessel’s maximum capacity is not permitted. Go Romana Charters reserves the right to deny boarding to unregistered passengers or if capacity is exceeded.

14. Force Majeure

Neither party shall be liable for failure to perform caused by events beyond their reasonable control, including but not limited to: natural disasters, pandemics, civil unrest, government restrictions, national emergencies, or any other force majeure event. In such cases, Go Romana Charters will make reasonable efforts to reschedule the charter or issue a credit.

15. Gratuities

Gratuities for the captain and crew are not included in the charter price and are at the guest’s discretion. Customary gratuities range from 15% to 20% of the charter cost.

16. Media Authorization

The Guest authorizes Go Romana Charters to use photographs and videos taken during the charter for promotional and marketing purposes, including social media and website. If the Guest wishes to opt out, they must notify in writing before the charter.

17. Credit Card Payments

Credit and debit card payments are subject to a processing surcharge to cover transaction fees. This surcharge is disclosed at the time of payment. Wire transfer, Zelle, and local bank transfers carry no additional fees.

18. Booking Confirmation

Signing the charter agreement alone does NOT confirm the charter booking. The charter is considered confirmed only when both conditions are met: (1) the charter agreement has been signed, and (2) Go Romana Charters has received the required deposit or full payment, as applicable. Until both conditions are met, vessel availability is not guaranteed and the requested date may be booked by another client.

19. Identity Verification

For the safety of all guests and crew, the primary guest must complete identity verification before the charter. Go Romana Charters reserves the right to deny boarding if identity verification has not been completed.

20. Entire Agreement & Severability

This agreement constitutes the entire agreement between the parties. If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Prior Agreements

Charters booked and confirmed prior to the launch of this website that are governed by a previously executed agreement (including DocuSign or other signed contracts) shall be subject to the terms of that prior agreement. In the event of a conflict between a prior agreement and these terms, the prior agreement shall prevail for that specific booking.

Go Romana Charters is an independent charter service and is not affiliated with, endorsed by, or operated by Casa de Campo Resort & Villas.
